The Lagos State High Court sitting in Ikeja has ruled that the removal of Mudashiru Obasa from his position as Speaker of the Lagos State House of Assembly was not done according to the law.
Justice Yetunde Pinheiro delivered the judgment on Wednesday, describing the actions taken by the lawmakers in January as unconstitutional. The judge also nullified all proceedings and resolutions that led to Obasa’s removal from office.
The case was brought before the court by Obasa, who filed a lawsuit challenging the manner in which he was removed. In the suit, he named the Lagos State House of Assembly and Mojisola Meranda, who was appointed as the new Speaker, as defendants.
Obasa’s legal representative, Chief Afolabi Fashanu (SAN), told the court that the lawmakers carried out the decision to remove his client when the Assembly was officially on recess.
He further noted that Obasa was not in the country when the move was made, calling it a deliberate attempt to sideline him without due process.
