The Court of Appeal sitting in Ibadan has ruled in favor of Oba Ghandi Olaoye, affirming his selection and installation as the Soun of Ogbomoso. The decision overturns a previous judgment by the Oyo State High Court, which had nullified his appointment.
The ruling was delivered on Tuesday by a three-member panel led by Justice Yargata Nimpar. The panel upheld Oba Olaoye’s appeal on all 10 grounds, effectively reinstating his legitimacy as the traditional ruler of Ogbomoso.
The legal battle over the Soun of Ogbomoso title began after Justice K. A. Adedokun of the Oyo State High Court ruled on October 25, 2023, that the selection process was irregular.
The lower court found that it did not comply with the provisions of the 1958 Soun Chieftaincy Declaration, declaring the appointment “null and void.” This decision led to uncertainty and a prolonged dispute over the rightful holder of the title.
However, with the latest ruling from the appellate court, the controversy appears to be settled in favor of Oba Olaoye. The court set aside the previous judgment, confirming his position as the legitimate Soun of Ogbomoso.
