NBA Condemns Farotimi’s Arrest, Invasion Of His Office

The Nigerian Bar Association (NBA) has expressed strong disapproval of the arrest of lawyer Dele Farotimi by the Nigeria Police Force. Farotimi’s arrest reportedly stems from allegations of libel. The NBA condemned the incident, describing it as an attack on the rule of law and the legal profession.

In a statement issued in Abuja on Tuesday night, NBA President Afam Osigwe criticized the police for allegedly invading Farotimi’s law firm and harassing its staff. Osigwe emphasized that while law enforcement has the right to investigate crimes, such actions must remain lawful and respect Nigeria’s legal framework.

Osigwe pointed out that the alleged offense for which Farotimi was arrested—libel—is not considered a criminal act under Lagos State law. He referred to the Criminal Law of Lagos State 2011, which decriminalized defamation, treating it instead as a civil issue.

“We must reiterate that the alleged offence of libel, for which Dele Farotimi was reportedly arrested, is not recognised as a criminal offense under the laws of Lagos State.

“The Criminal Law of Lagos State 2011 repealed the criminalisation of defamation by omitting it from its provisions.

“This progressive legislative move aligns with global best practices, which treat defamation as a civil wrong rather than a criminal offence,” he stated.

Reports suggest that Farotimi was taken from his Lagos residence and transported to Ado-Ekiti in Ekiti State for questioning. The arrest has sparked widespread criticism, with many notable Nigerians voicing their concern. Farotimi is accused of defaming Tony Elumelu, the Chairman of the United Bank for Africa Group.
